Today we learn that Vimeo has agreed to an acquisition by European digital technology company Bending Spoons. In this bundling, Vimeo joins previously acquired brands, including Evernote and WeTransfer. The deal will remove Vimeo from public trading and turn it into a privately held subsidiary. Video/audio streaming site Video has prevailed in a copyright infringement lawsuit brought by major music labels Universal Music Group (UMG) and Sony Music. This is not the first time Vimeo has tangled with labels over the same issue, as RAIN reported in 2016 in Capital Records vs. Vimeo. The fulcrum in both cases is the Digital Millennium Copyright Act (DMCA), enacted in 1998.

One of the recent developments in pre-1972 copyright protection was a win by video hosting service Vimeo in June, where the court ruled that the company could apply safe harbor provisions to those songs. That appeal ruling is now facing a fresh attack. A2IM, the RIAA, and Concord have filed an amicus brief in support of original plaintiff Capitol Records and requesting that the full New York federal appellate court rehear the case. Continue Reading
