Personal Audio seeks appeal in lost podcasting patents

eff logo canvasThe Electronic Frontier Foundation may return to court for its case against Personal Audio over podcasting patents. After filing several patent infringement cases against large and small podcasting outfits, key elements of Personal Audio’s intellectual property protections were invalidated last spring. The EFF argued that the claimed inventions existed prior to Personal Audio filing its patent application. The podcast lawsuits, one of which targeted star podcaster Adam Carolla, were widely regarded as patent trolling.

Personal Audio has since filed an appeal of the decision, and the EFF is trying to confirm its ability to participate in that appeal. Oral arguments before a panel of the U.S. Court of Appeals for the Federal Circuit are slated to begin today.
